FIRST CLASS BEER SELECTION (optional) - If you would like an additional beer from your brewery considered for selection for our First Class Ticket guests please list one or more beers we may choose from. We will select up to 4 beers and anticipate having as many as 250 First Class Ticket holders.

Terms and Conditions
Thank you for your interest in being a participating brewery at the Hops in the Hangar event. This highly anticipated, unique, ticketed event will draw attendees from the tri-state area and will feature a tasting of 80+ select brews from up to 30 local craft breweries, all in an aviation backdrop. It is an event like no other! Attendance is projected to be 1,000. Proceeds from the event to benefit Midwest Honor Flight. We'd love for you to jump on board! To have your brewery considered for participation please read, acknowledge your acceptance, and submit the following Participation Agreement and completed Event Application by no later than May 31, 2023. Although this is the deadline for submitting an application, please be aware that brewery selections may be made prior to this date.
PARTICIPATION AGREEMENT
For the purposes of this Agreement, the terms “you” and “your ” shall mean the business or company identified as the brewery attending the event and filling out this form; the terms “we” “our” "us" and “HITH” shall mean the Hops in the Hangar planning organization as well as, and including, the partnering organizations and their board of directors, members and agents; the term “event” shall mean the Hops in the Hangar event scheduled to take place on Saturday, July 22, 2023; the term “event site” shall mean the designated event area of the Maveric Air Center in Sioux Falls, SD. Upon selection by the event committee to participate in the Hops in the Hangar event you agree to and acknowledge the following:
1. BREWERY SELECTION
If selected to participate in the event we will notify you by email and/or phone call. Once selected and notified we must receive payment of the event booth fee donation within 10 days in order to confirm your space and commitment to participate.
2. BEER SELECTION
Please note that once beer selections have been made substitutions will only be permitted with the consent of HITH. No beer substitutions will be permitted within 14 days of the event date.
Invoices from breweries or distributors for all orders placed by HITH are limited to the cost of products ordered and any required container deposits. All other fees or charges required by you as a condition of your participation in the event must be listed and detailed on your event application and are subject to approval by HITH. If you have a conditional minimum order amount you must indicate the amount when completing your event application.
3. EVENT SITE ACCESS
You will have access to the event site on the day of the event from 11:00 AM - 3:00 PM to set up dispensing vehicles, tents, and other equipment in your designated space. Your designated 10’ x 10’ space will be preassigned by the event committee prior to the event date. Upon arrival at the event site, please contact the brewery coordinator for your space assignment.
Each 10' x 10' brewery space includes: one 8’ table and ice (as needed.) We do not provide dispensing and/or cooling equipment, chairs, tents, or other equipment.
Only approved beer dispensing vehicles will be permitted in or near the event hangar between 3:00 PM and the end of the event. All vehicles used for the towing of dispensing trailers must be disengaged and parked in the designated vendor parking area prior to the 3:00 PM deadline.
4. BREWERY BOOTH PREPARATION, USE, AND STAFFING
You will be assigned a designated space from which to serve beer samples on the day of the event. Without exception, you may not share your space with another vendor or with any other company or business whether or not such company or business has completed the application process and made a donation to HITH.
Your space must be set up and ready to serve ticket holders, volunteers, and other attendees of the HITH event on the day of the event from 4:00 PM - 9:00 PM. A minimum of one event volunteer will be assigned to each brewery space for the purpose of pouring beer as needed.
Your business and other activities must be conducted within your designated space. You may not distribute, canvass, sell, advertise or promote any food, merchandise, products or services in areas outside of your designated space. Displaying of signs and other advertisements is only permitted within your designated space area unless prior permission has been obtained from HITH.
You are responsible for knowing the laws, codes, and regulations relating to: dispensing your product, your equipment, including electric appliances, and all of your equipment and appliances must function in accordance with such codes and regulations. You will be responsible for bringing extension cords, generators and/or other equipment necessary to ensure your equipment is fully functional.
You are responsible for having and procuring all necessary liability and other insurance relating to your business, employees, merchandise and/or property at the event. By entering this agreement you agree to indemnify us and hold us harmless for any and all claims relating to your business, products, employees, merchandise and/or property that may arise as a result of your participation in the event.
In order to protect your property, do not leave your vehicle, tent, or other personal items unattended at any time during, before or after the event. Brewery representatives are responsible for their equipment, beer, and other property brought to the Event. HITH assumes no liability for theft or loss of any kind.
Non-food vendors are prohibited from selling food or drinks of any type during the event. You may not sell alcoholic beverages of any kind. The sale of alcoholic beverages is strictly prohibited and will result in your immediate expulsion from the event and exclusion from future participation in HITH events.
By executing this Agreement, you grant us or any airport persons permission to inspect your space, dispensing vehicle, equipment, merchandise and products during the event.
5. POST-EVENT BREAKDOWN
You must remove all of your equipment and other property from the event site between 9:00 PM and 12:00 AM on the day of the event. All trash, recyclables, and other waste must be placed into an available waste container or stacked neatly within your designated space. CLOSING BEFORE THE EVENT ENDS, CONTINUING TO SERVE PATRONS AFTER THE EVENT ENDS, OR NOT PROPERLY DISPOSING OF LITTER OR OTHER WASTE WILL BE GROUNDS FOR EXCLUSION FROM YOUR PARTICIPATION IN FUTURE HITH EVENTS.
6. ADDITIONAL TERMS, PROVISIONS AND CONDITIONS
Our obligation to place your logo on the festival website, t-shirts, banners or any other promotional material is contingent on your ability to timely provide us with proper digital files containing appropriate copies or images of your logo. We recommend you provide your logo to us in the following format(s): PNG, EPS, or AI with 300 dpi resolution. We will also accept TIFF and JPG file formats. We will not design, format or re-format your logo for the purposes of event advertising. Insofar as you have provided us with proper digital copies of your logo, we will place a color logo on the website; logos on printed materials, including t-shirts and banners if indicated by sponsorship and, will be printed in either black or white ink at our discretion.
By executing this Agreement, you acknowledge that you understand the Hops in the Hangar event is a fundraiser for Midwest Honor Flight. You further understand your booth fee, if any, will be used to cover the expenses of equipment, supplies, planning, organizing, promoting and conducting the event. Accordingly, should you decide to withdraw from the event, or fail or decline to participate for any reason, you will NOT receive a refund of any fees you have paid. If we cancel the event, for any reason, our liability is limited to refunding any fees or sponsorship you may have paid to HITH.
THE EVENT WILL OCCUR "RAIN OR SHINE."
You understand that your submission of this Participation Agreement and Event Application does not guarantee your selection as a participating brewery. Your submission of this Agreement and Application shall not bind you or HITH until you have been formally selected for event participation and you have tendered the required fee to HITH. Further, you agree and understand that if we are unable to process your payment for any reason (e.g., insufficient funds, returned check), you agree to reimburse HITH for all reasonable and expected costs and expenses incurred by us in attempting to process your payment.
All correspondence about the event, including notification of selection, changes relating to this Agreement and information regarding the time and/or location of the event will be emailed to you or communicated to you by phone using the contact information provide to us from your completed Event Application. In addition, general information about the event will be posted on the official Hops in the Hangar page (www.midwesthonorflight.org/hops). No updates will be directly mailed to you.
You understand that any violations of the terms or conditions of this Agreement may result in the revocation of your selection as a participating brewery as well as your potential forfeiture of any paid fees and/or sponsorship.
If we fail to enforce any term, provision or condition of this Agreement, it shall not be construed as a waiver of such term, provision or condition or of our right to enforce the same. Waiver of either party hereto of any breach or default by the other party shall not operate as a waiver of any other breach or default. This Agreement shall be governed and construed in accordance with the laws of the State of South Dakota without regard to conflicts of law principles.
